Terms and Conditions of Participation

This page contains the terms and conditions for giveaways organized by us. Part A applies to all giveaways. In addition, the platform-specific conditions in Part B (Instagram) or Part C (weekly raffle in the “Kölsch Catch” app) apply.

Part A — General Terms and Conditions of Participation

A1. Organizer

The organizer of the giveaways is:

hereinafter referred to as “The Kölsch Crew” or the “Organizer”.

These general terms and conditions of participation apply to giveaways organized by The Kölsch Crew, unless otherwise stated in the supplementary conditions of the respective part or in the respective giveaway announcement.

The specific conditions of the giveaway in question, in particular

the participation period,
the type and requirements for participation,
type, scope and number of prizes,
any special requirements for redeeming the prize, and
any method of selecting the winner

are set out in the supplementary conditions of the respective part and in the respective giveaway announcement.

The respective giveaway announcement and these general terms and conditions of participation together form the terms and conditions of participation for the respective giveaway.

A2. Eligibility

Natural persons aged 18 and over residing in Germany are eligible to participate, unless a different group of participants is specified in the supplementary conditions or in the giveaway announcement.

Employees of The Kölsch Crew as well as persons directly involved in the conception or execution of the respective giveaway are excluded from participation.

Participation is free of charge and not dependent on the purchase of goods or services, unless expressly stated otherwise.

Participation requires fulfillment of the requirements stated in the supplementary conditions.

A3. Participation and participation period

How to participate in a giveaway and the period within which participation is possible are set out in the supplementary conditions of the respective part.

Entries submitted outside the participation period stated there, or that do not meet the stated participation requirements, cannot be considered when selecting the winner.

A4. Prize

The type, number, and scope of the prizes to be won are set out in the supplementary conditions or the giveaway announcement.

Cash payment of the prize or any equivalent value is excluded.

As a rule, the prize claim cannot be transferred to other persons unless The Kölsch Crew expressly agrees to a transfer.

If the prize consists of a tour, event, experience or other time-bound service, the dates, redemption periods and other requirements stated in the giveaway post also apply.

If a winner cannot attend a set date for personal reasons, there is no entitlement to an alternative date or a payout of the prize value, unless otherwise stated in the respective giveaway post.

A5. Winner selection

Winners will be determined after the end of the respective participation period.

Unless otherwise stated, winners are selected at random from all valid entries.

If the selection is based on a creative contribution, an answer to a question or other evaluation criteria, this will be stated in the respective giveaway post.

The method by which a winner is notified is set out in the supplementary conditions of the respective part.

To process the prize, The Kölsch Crew may ask the winner to provide further information within a reasonable period of time.

If a winner does not respond within the period specified in the supplementary conditions, the claim to the prize may lapse. The consequence of such a lapse is set out in the supplementary conditions.

A6. Delivery and redemption of the prize

The method of delivery or redemption depends on the type of prize in question.

For physical prizes, providing a shipping address may be required in order to send the prize.

For vouchers, tours, events or other services, providing additional data required for booking or redemption may be necessary.

Any additional costs that are not expressly part of the prize are to be borne by the winner. This includes, for example, travel, accommodation or other incidental costs, unless these were expressly designated as part of the prize.

A7. Exclusion from the giveaway

The Kölsch Crew is entitled to exclude participants from the giveaway if there is an objective reason for doing so.

An exclusion may occur in particular in cases of:

manipulation or attempted manipulation of the giveaway,
use of automated systems, bots or comparable technical aids,
use of multiple accounts or devices to artificially increase the chance of winning, insofar as multiple entries are not expressly permitted,
false or misleading information,
breaches of these terms and conditions of participation,
violations of the supplementary conditions or
unlawful or inappropriate posts or content.

If a reason for exclusion is identified at a later date, a prize that has already been awarded may be revoked and, if applicable, a new winner may be selected.

A8. Changes to or early termination of the giveaway

The Kölsch Crew reserves the right to change, suspend or end a giveaway early for good cause if proper execution can no longer be guaranteed.

This may be necessary in particular in the event of technical disruptions, attempted manipulation, outages of a platform used, or for legal reasons.

A change or early termination will not be arbitrary and does not affect any statutory claims that have already arisen.

A9. Data protection

The controller responsible for processing personal data in connection with the giveaway is:

Which personal data is processed as part of a giveaway depends on the platform used and is described in the supplementary conditions of the respective part.

The data will be processed exclusively to the extent necessary to run the giveaway, select and notify the winners, and deliver or redeem the prize.

Insofar as processing is necessary for participation in the giveaway and its handling, it is carried out on the basis of Art. 6(1)(b) GDPR.

The data collected as part of the giveaway will not be used for advertising or newsletters without a separate legal basis and/or consent that may be required for this purpose.

After the giveaway has been fully processed, personal data collected additionally for prize processing will be deleted, unless there are statutory retention obligations or other legitimate reasons for further storage.

A10. Announcement of winners

As a rule, the full name of a winner will not be publicly announced without their consent.

Insofar as this is necessary for the implementation of the giveaway and is recognizable in the supplementary conditions, a publicly visible username or nickname of the winner may be used for the announcement or for contacting them.

A11. Liability

The Kölsch Crew is liable without limitation for damages caused intentionally or by gross negligence, as well as for damages resulting from injury to life, body or health.

In the event of a slightly negligent breach of essential contractual obligations, liability is limited to the foreseeable damage typically occurring.

Otherwise, liability for slight negligence is excluded to the extent permitted by law.

The Kölsch Crew assumes no responsibility for technical disruptions or restrictions of a platform used that are outside The Kölsch Crew’s sphere of influence.

A12. Legal recourse and applicable law

The law of the Federal Republic of Germany applies, excluding those provisions whose application would exclude mandatory consumer protection provisions of the state in which a consumer has their habitual residence.

Legal recourse regarding the selection of winners is excluded to the extent permitted by law.

Statutory rights of participants remain unaffected.

A13. Relationship between the parts

The supplementary conditions in Part B and Part C as well as the information in the respective giveaway announcement supplement these general terms and conditions of participation.

Insofar as the supplementary conditions or the giveaway announcement contain expressly deviating regulations, these deviating details apply to the giveaway in question, to the extent permitted by law.

A14. Final provisions

Should individual provisions of these terms and conditions of participation be or become wholly or partially invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.

Part B — Supplementary Conditions for Giveaways on Instagram

B1. Scope

This part applies in addition to Part A for giveaways organized by The Kölsch Crew via The Kölsch Crew’s Instagram account.

The participation period, entry action, prize, and, if applicable, special participation or redemption conditions are specified in the respective giveaway post on Instagram.

B2. Participation

How to participate in a giveaway is specified in the respective giveaway post on Instagram.

If participation is by comment, the comment must not contain any unlawful, insulting, discriminatory, derogatory or otherwise inappropriate content.

If other Instagram users are mentioned or tagged as part of participation, only people should be named where it can be assumed that the mention is not unwanted. Impermissible, automated or mass tagging may be excluded from the giveaway.

Multiple entries are only permitted if this is stated in the respective giveaway post.

B3. Notification of winners

Winners will be notified via Instagram, for example by direct message, by replying to their comment, or by an announcement via The Kölsch Crew Instagram account.

If a winner does not respond to such a request within 7 days of being notified of the prize, the prize claim may lapse. In this case, The Kölsch Crew is entitled to select a new winner.

B4. Data processing for Instagram giveaways

As part of a giveaway on Instagram, the following personal data may be processed in particular:

Instagram username,
name or publicly visible profile data,
comments and other content submitted as part of participation,
for winners, where applicable, email address, postal address, telephone number or other information required to process the prize.

Data processing by Instagram or Meta takes place independently in accordance with their applicable data protection provisions. The Kölsch Crew has only limited influence over data processing by Instagram or Meta.

B5. No connection to Instagram or Meta

The Kölsch Crew giveaways are in no way connected to Instagram or Meta and are not sponsored, supported or organized by Instagram or Meta.

Instagram or Meta is neither the organizer nor a point of contact for the giveaways.

All questions, notes or complaints about the respective giveaway must be directed exclusively to The Kölsch Crew and not to Instagram or Meta.

Participants release Instagram or Meta from liability for claims in connection with the respective giveaway, insofar as this is legally permissible and required under the platform’s terms.

Part C — Supplementary Conditions for the Weekly Raffle in “Kölsch Catch”

C1. Scope

This part applies in addition to Part A for the weekly raffle in The Kölsch Crew’s “Kölsch Catch” app.

C2. Participation and participation period

A raffle period begins every Sunday at 6:00 PM and ends the following Sunday at 6:00 PM (Europe/Berlin time zone). The time of the end is also the time of the draw.

Participation is automatic: Anyone who enters a score into the app’s global leaderboard within a raffle period participates in the raffle for that period with that entry. A separate registration is not required, and there are no costs.

The time at which the score is received on The Kölsch Crew’s server is decisive, not the time on the device used.

Only the best score per device in a raffle period will be considered.

C3. Prize pool

The ten best scores of the respective raffle period participate in the draw. Within these ten, each score has the same chance of winning; the points achieved determine inclusion in the prize pool, not the probability of winning.

Scores whose point total is technically unattainable in relation to the playing time will be excluded from the raffle. They remain visible in the leaderboard.

If fewer than ten scores participate, the draw will be made from all participating scores.

C4. Prize

One voucher for a free spot on a beer house tour by The Kölsch Crew is raffled per raffle period. The specific tour the voucher applies to is stated on the voucher.

The voucher is valid for twelve months from the date of issue. Travel, consumption, and other incidental costs are not part of the prize.

C5. Winner selection

The draw takes place automatically on The Kölsch Crew’s server at random. The random value used is formed from the time of the draw and a key known only to The Kölsch Crew; the group of participants and the random value are logged so that a draw can be traced.

If the draw cannot be carried out technically at the scheduled time, it will be made up for at the next possible time. A maximum of one draw takes place per raffle period.

C6. Notification, collection, and lapse

Since neither a user account nor an email address is collected for participation, notification takes place exclusively in the app: If a prize is ready for a device, this will be displayed when the app is opened. Anyone who does not open the app after the draw will not find out about a win.

Upon collection, the winner confirms that they are at least 18 years old and have read these terms and conditions of participation. Only then will the voucher code be displayed.

The prize must be collected within two weeks of the draw. If it is not collected within this period, the claim lapses; in this case, the voucher will be raffled additionally in the following raffle. There will be no moving up of the next-placed score.

Upon request, the winner can also have the voucher sent to them by email. The email address provided for this purpose will be used exclusively for this dispatch and will not be stored by The Kölsch Crew; it must be provided again for a new dispatch.

C7. Exclusion of participation

Anyone who does not wish to participate in the raffle can permanently switch off participation in the app settings. The scores achieved will then still appear in the leaderboard but will no longer participate in draws. This decision can be changed at any time.

C8. Data processing for the weekly raffle

The following are processed as part of the weekly raffle:

the anonymous device ID of the app as well as the self-chosen nickname, the score, the level reached, and the time of the score,
in the event of a win, additionally the issued voucher code and its assignment to the device ID until the voucher has been collected or has expired,
in the case of a request for dispatch, the email address provided, which is passed on exclusively for delivery to our service provider for the booking system and is not stored.

A name, address, or telephone number is not collected for participation.

A winner’s nickname can be displayed in the app along with the time of the draw so that the draws are traceable. The nickname is self-chosen and appears in the public leaderboard anyway.

C9. No connection to Apple or Google

The weekly raffle is in no way connected to Apple or Google and is not sponsored, supported, or organized by Apple or Google.

Neither Apple nor Google is the organizer or contact person for the raffle. All questions, information, or complaints should be directed exclusively to The Kölsch Crew.
